Terms of Service

These Terms of Service (“Terms”) govern your use of Eviolite(the “Service”), operated by ERC MARKETING FZ-LLC, a free zone limited liability company registered in the United Arab Emirates (“ERC”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Eviolite lets you generate images and videos using artificial intelligence, on a prepaid credit basis. We may modify, improve, or discontinue features at any time.

2. Accounts

You must provide accurate information and are responsible for keeping your credentials and API keys secure and for all activity under your account. You must be at least 18 years old.

3. Credits and expiration

• Credits are purchased in prepaid packs and are consumed as you generate content (one credit per generation request, regardless of how many variations it returns).
• Credits expire. Each pack has a validity period shown at purchase; unused credits are forfeited when the pack expires.
• Credits have no cash value and cannot be transferred, resold, or exchanged.

4. No monetary refunds

All purchases are final. We do not provide monetary refunds of any kind, whether for unused credits, expired credits, partially used packs, change of mind, or dissatisfaction with generated results. By purchasing, you expressly acknowledge and accept this policy. This does not limit rights that cannot be waived under applicable mandatory law.

4.1 Service interruptions — our remedy is credit

If a generation fails for a reason attributable to us or our providers, the credit for that request is automatically returned to your balance. If a prolonged service interruption attributable to us prevents you from using valid credits — including where it causes them to expire — your sole and exclusive remedy is that we will, at our discretion, restore those credits or extend their validity so you can use them once the Service is available again. This does not entitle you to a monetary refund.

5. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• is illegal, or infringes intellectual property, privacy, or publicity rights;
• is sexual content involving minors, or non-consensual intimate imagery;
• harasses, defames, or impersonates others, or is intended to deceive or defraud;
• promotes violence, hatred, or self-harm;
• attempts to disrupt, reverse engineer, overload, or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate these rules, without refund.

6. Your content and generated output

You retain the rights you hold in the prompts and reference images you submit. Subject to your compliance with these Terms and to the terms of the underlying AI provider, we assign to you our rights, if any, in the output generated for you. You are solely responsible for your use of any generated content and for ensuring you have the rights to any material you upload. Generated output may not be unique and similar content may be produced for other users.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

8. Limitation of liability

To the maximum extent permitted by law, ERC MARKETING FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our total liability for any claim relating to the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless ERC MARKETING FZ-LLC from any claims or damages arising out of your content or your use of the Service in violation of these Terms or applicable law.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms. No refunds are provided upon termination.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. The courts of the United Arab Emirates shall have exclusive jurisdiction, unless mandatory law in your place of residence provides otherwise.

12. Changes

We may update these Terms. Continued use after changes take effect constitutes acceptance of the updated Terms.
